Names “.com.es�, “.nom.es�, “.org.es�, “.edu.es� and “.gob.es�

* Under the indicative “.com.es�:
They will be able to ask for it the physical or legal people and the organizations without personality that bonds with Spain maintain.

* Under the indicative “.nom.es�: They will be able to ask for it the physical people who maintain bonds with Spain.

* Under the indicative “.org.es�:
They will be able to ask for it the organizations, institutions or groups with or without legal personality and spirit of profit that maintain bonds with Spain.

* Under the indicative “.gob.es�:
They will be able to ask for it the Spanish Public Administrations and the organizations of Public Right of her employees.

* Under the indicative “.edu.es�:
They will be able to ask for it the organizations, the institutions or groups with or without legal personality that enjoy official recognition and realize activities related to education or the investigation in Spain.

* The dominions .es will be followed assigned if it meets the following requirements:

a) Not to be previously assigned.
b) To fulfill the syntax norms (separated 3,2).
c) Not to be included within the prohibitions (separated 3,3).
d) To fulfill the norms general of derivation of dominion names (separated 3,4).

1. - Norms of syntax:

a) The unique valid characters for a name of DNS dominion are the letters of the English alphabet (“to� - “z�, the DNS does not distinguish between capital letters and small letters), the digits (“0� - “9�) and the script (“-�).
b) First and/or the last character of the dominion cannot be the script.
c) The admitted minimum length for a dominion of second low level “is� is of 3 characters (the recommended minim to diminish the probability of conflicts is of 5 characters).
d) The admitted maximum length for a dominion of second low level “is� is of 63 characters (the recommended principle, by practical reasons, is of 24 characters).

2. - Prohibitions. In no case the allocation of a name of regular dominion will be admitted that:

a) It agrees with some name of dominion of DNS of first level (TLD's). (for example: edu�, “com�, “gov�, “thousands�, “org�, “int�, “net�, “ARPA�), either with one of proposed by some of the groups or the organizations of recognized authority in “Internet� (for example: “firm�, “store�, “Web�, “arts�, “rec�, “info�, or “nom�).

b) One is made up exclusively of a place-name (for example: countries, regions, provinces, regions, municipalities, towns, islands, gentilicios, mountains, seas, Lagos, rivers or monuments).

c) One is made up exclusively of a generic one of products, services, establishments, sectors, professions, activities, likings, religions, social areas of the human knowledge, technologies, classes or groups, animal, vegetal or mineral diseases, species, qualities or characteristics of the people, the alive beings or the things.

d) It agrees with names of protocols, applications and terminology of Internet (for example: “SSH�, “FTP�, “email�, “www�, “Web�, “smtp�, “HTTP�, “tcp�, “dns�, “wais�, “news�, “RFC�, “IETF�, “MBONE�, “BBS�).

e) One is made up, exclusively, of a combination of the cases contemplated in the three previous sections.

However, the allocation of regular names of dominion will be able to be admitted that are made up, exclusively, of a combination of the cases contemplated in the three previous sections when this combination identifies, of unequivocal form, to the organization applicant. This assumption, will only be of application for organisms public and organizations of unquestionable recognition by the public in all the State.

f) It includes terms or expressions that are opposite to the Law, the moral or the public order.

g) It is associated of public and well-known form another organization, acronym or marks different from the ones of the applicant of the dominion.

h) One is made up, exclusively, of own names or last names, except for when a mark or commercial name registered in the Spanish Office of Patents and Marks to name of the organization corresponds literally with applicant of the dominion. It is understood notwithstanding the allocation, without the mentioned restrictions, of subdominions to the physical people.

i) One is made up, exclusively, of a sequence of digits, except for when a mark or commercial name registered in the Spanish Office of Patents and Marks to name of the organization corresponds literally with applicant of the dominion.

The prohibitions established in the sections preceding b), cs) and e) will not be of application to the requests of dominion names that reproduce the one of the organization literally applicant of the dominion, as it appears in the corresponding public Registry, or the one of one of their marks or commercial names registered in the Spanish Office of Patents and Marks. In the case of the mercantile societies, the social denomination or includes its social form or abbreviation. For the rest of organizations indicated in section 2, the dominion name will have to be qualified with the corresponding social form.

3. - General Norms of derivation of dominion names.

3.1 The following will only be able to be assigned like regular names of dominion:

a) The complete name of the organization, as it appears in his writing or document of constitution.

b) An acronym of the complete name of the possible most qualified organization, so that he is direct and easily associable to the official name of the organization. Preferably an acronym habitually used by the organization and legally registered in the Spanish Office of Patents and Marks.

c) One or several commercial denominations or marks legally registered in the Spanish Office of Patents and Marks. Labels of establishments will not be admitted, dice their local character.

The physical people will only be able to receive the allocation of the anticipated names of dominion in the commercial section (c), that is to say, denominations or registered tradenames of which they are titular.

3.2 She will not allow herself any organization very intuitively to receive the allocation of an acronym that does not correspond reasonable and with the official name of this organization.

3.3 Dominions that incorporate jokers or postcripts (type suffix “net� or area code “Inter�, etc.) will not be admitted either that does not have relation some with the official name of the organization applicant

3.4 When from the application of the present general norms of derivation of dominion names is one in contradiction with the arranged thing in sections 3,2 and 3,3, the dominion name will not be admitted and will have to be modified or qualified of such form that fulfills these norms. This is thus even when the name of proposed dominion literally corresponds with the complete name of the organization applicant or with the one of one of its registered tradenames. For example, if it contains characters nonallowed, these will have to be replaced by other relatives by marriage (for example, “n� by “n� or “ny�); if the dominion name turns out to be a generic one or toponímico it has to be qualified with the legal form of the organization (for example, “- sa�, “- sl�, “- sc�, “foundation� or “fund-�, “association� or “asoc-�) or, if it were a mark, with the number among the 42 classes of the international nomenclátor of products and services under which applicant of the dominion is registered by the organization (for example, “- 38�, “- c38� or “- class 38�).
